SBH Marine Equipment/Rent for fun terms and conditions.
1. Applicability
These general terms and conditions apply to all rental and assignment agreements concluded by SBH Marine Equipment bv/Rent for fun with tenants and concern the materials mentioned in these general terms and conditions unless expressly agreed otherwise.
2. Definitions
In these General Terms and Conditions, the following definitions apply:
Landlord: SBH Marine Equipment bv/Rent for fun based in Burgh Haamstede. Also referred to as Rent for fun
Tenant: the natural or legal person who rents materials from the landlord for a certain period of time on the basis of an agreement.
Materials: all materials and (electrical) devices that the landlord makes available for rent, as well as all accessories, motors, ropes, ship materials and means of transport associated with the above items.
3. Quotation
The offers issued by the landlord are non-binding. The materials are not being considered as an option.
4. Rental period
The materials are rented out for a specified period of at least 3 days or 72 hours. The rental period commences at the time when the materials rented in accordance with the agreement leaves the landlord's warehouse and ends when the rented equipment returns to that warehouse, unless otherwise agreed in writing.
5. Rates/payment
The tenant is expected to know and agree to the rental rates used by the landlord. The tenant must pay the rental price in cash and in full before or at the start of the rental period or by bank transfer, iDEAL in advance, unless otherwise agreed in writing.
6. Cancellation
If the tenant has taken an option from the landlord to rent materials and subsequently wishes to refrain from renting them, the following cancellation provisions apply. If the tenant cancels the proposed rental agreement earlier than on the seventh day before the start of the rental period, cancellation can be made free of charge; earlier than on the fourth day before the start of the rental period, the tenant owes 25% of the rent; later than the third day before the start of the rental period, the tenant owes the full rent.
7. Deposit
The landlord has the right to ask for a deposit.
8. Requirement of legitimation
Before entering into the rental agreement with the tenant, the landlord can oblige the tenant to identify himself by showing the landlord one or more legally valid proof of identity as well as a copy of a bank or giro statement no older than 14 days.
9. Use
The tenant will only use the materials for the purpose for which they were manufactured. The tenant will handle the equipment as a good family man/mother and will also ensure appropriate and safe storage. The tenant is obliged at all times to provide free access to buildings, yards or other places where the rented equipment is located to have the condition of that equipment inspected.
10. Control of the rented property
To prevent problems, the tenant must check this immediately after receiving the rented property and if there are defects, defects or other complaints, the tenant must report this to Rent for fun without delay
11. Transport/Transport
The tenant transports the rented property entirely at his own expense and risk. It is possible to have Rent for fun deliver and pick up the rented materials. If desired, an appointment must be made about this separately. Delivery and collection by Rent for fun may be associated with costs.
12. Operation
12.a. The tenant declares to ensure that the equipment is delivered to him in good condition from the warehouse/place of the landlord. By entering into the rental agreement, the tenant declares that he is familiar with the functioning of the materials and acknowledges that the equipment rented by him meets the purpose for which he rents the materials.
12.b. If a failure occurs in or to the rented materials during the rental period, the tenant must report this immediately to the landlord. The tenant is not allowed to repair faults and/or carry out repairs to the rented equipment himself, unless this has been expressly agreed in writing between the parties. If faults or defects in or on or of the rented equipment are not reported directly or at all to the landlord, the tenant is fully liable for all damage that will result from this.
13. Defaults and compensation.
13.a. The materials must be collected by the tenant from the landlord's warehouse/location, unless otherwise expressly agreed. If the tenant does not pick up the rented property in time at the agreed time of the start of the rental period, this is entirely at his own expense and risk. The rental price is due at all times over the rental period agreed in writing.
13.b. The materials must be returned by the tenant to the landlord's warehouse/place no later than the date on which the agreed rental period ends, unless otherwise agreed in writing. If the tenant has not returned the rented equipment by that end date, for whatever reason, as well as in the event of damage to the equipment, for whatever reason, the tenant is therefore in default without any reminder or notice of default being required. In that case, without prejudice to his other obligations towards the landlord, the tenant owes compensation to the landlord. In the event of late delivery, this compensation amounts to the rental price per day for each day that exceeds the agreed rental period, plus 50% of that rental price. In the event of damage to the equipment, the tenant owes the costs of repairing those damages as compensation as well as the rental price per day for each day associated with that repair plus 50% of that rental price.
13.c. If the landlord should suffer a higher amount of damage as a result of late return by the tenant and/or damage to the materials than the amount of compensation that would be owed by the tenant under the provisions of the previous paragraph, 13.b., of this article, the landlord will also be entitled to claim this additional amount from the tenant.
14. Notification obligation
In the event of theft, loss or damage to the materials, the tenant is obliged to report this to the landlord immediately. In addition, in the event of theft or loss or in the event of molestation damage, the tenant will immediately report this to the police of the municipality where that theft or molestation occurred and will immediately forward a copy of that report to the landlord. If the tenant does not comply with the obligations set out in this article, he is obliged to compensate the landlord for all damage that will result from the aforementioned events.
15. Insurances
15.a. By signing the rental agreement, the tenant declares that the rented property is not insured from the moment the materials leave the warehouse/location.
15.b. The tenant must provide comprehensive insurance on the rented materials against loss, theft, damage or other damage caused by or to the rented materials throughout the rental period. The insurable value of the rented goods will be notified to them by the landlord at the tenant's written request.
16. Damage
16.A.All damage caused to the materials during the rental period, regardless of the cause or cause thereof, is at the expense of the tenant if and insofar as compensation for that damage is not covered by any compensation taken out by the tenant.
16.B. The landlord is never liable for direct or indirect damage that occurs during the rental period as a result of the rented materials not functioning properly or not as expected or caused to persons and/or property by or when working with the rented materials.
17. Confidentiality
The tenant will not copy or show or disclose to third parties information concerning the designs and/or construction methods used by the landlord regarding the rented materials, which information becomes known to him through and/or when concluding and/or executing the rental agreement.
18. Landlord's right to refuse
The landlord has the right not to enter into a rental agreement at any time without giving reasons.
19. Use by third parties
The tenant is not allowed to rent or loan the rented equipment to third parties, whether or not for a fee.
